Trinity Guardrail Lawsuits: Know the Facts

Trinity Industries manufactured the ET Plus guardrail according to strict regulations laid out by the American Association of State Highway and Transportation Officials (AASHTO). The initial design was tested around the country in certified crash test facilities—and it was approved. The device received formal approval from the Federal Highway Administration (FHWA) in 2000. However, the device that was approved was not the issue.

In 2005, Trinity Industries apparently modified the project, changing a five-inch metal component of the design to a four-inch component. This allowed the company to save a considerable amount of money, but it also resulted in compromised safety for drivers and consumers. A single inch of metal ended up making all the difference.

A jury in the Eastern District of Texas ruled against Trinity in 2014, stating that the company withheld important information from the FHWA. This information involved the design flaw. This case resulted in a $175 million verdict that ended up being $525 million—the largest private whistleblower award ever recorded.
