A quiet redesign allowed dangerous changes to slip by the Federal Highway Administration (FHWA) unnoticed. A single inch of material was removed to save on costs. The initial design, approved in 2000, was compromised by these new design features. Many people were seriously hurt and even killed as a result of this defect.

The FHWA is responsible for approving devices used in the road systems and other safety matters pertaining to transportation. Trinity should have provided information to the FHWA that would have shed light on the flawed component in the design, but the corporation failed to do so. The result? The largest private whistleblower award in history: a $175 million verdict that ended up being $525 million.

Litigation is still pending against this company. The verdict—the result of a case in the Eastern District of Texas decided on October 14, 2014—could grow to as much as $1 billion in damages the company is forced to pay, along with the funds resulting from at least 9 different personal injury and wrongful death claims involving the guardrail.
