Judge Sides with Aldous Law and Its Client Dallas County Judge Clay Jenkins, Upholds Mask Mandate

Aldous Law Attorney Charla Aldous was back in Court on behalf of Dallas County Judge Clay Jenkins in a continuance of the high-profile litigation over local authorities’ ability to require masking to address COVID-19.

After a hearing in which Aldous Law attorneys and others on Judge Jenkins’s legal team presented expert testimony and arguments against the Governor’s controversial ban and reasons why it violated Judge Jenkins’ ability to manage the pandemic in Dallas County, District Judge Tonya Parker ruled in favor of Aldous Law’s client and granted Judge Jenkins’s request for temporary injunction blocking Gov. Greg Abbott’s ban on mask mandates.

Given the high-profile and politically charged issue, the Attorney General appealed the matter to the appellate courts. Ultimately, the matter will likely end up before the Texas Supreme Court, and Charla Aldous, along with the rest of Judge Jenkins’s legal team, is prepared to continue fighting on Judge Jenkins’ behalf and on behalf of the people of Dallas County.

As Charla Aldous told NBC:

"We are grateful the court recognized that in a local crisis, local responders such as Judge Jenkins are in the best position to decide what is best to protect local citizens. What’s more, the law in Texas conveys the authority on him, and other county judges, to take steps that are necessary to protect the people from this deadly virus. That is what he is determined to do and, with this ruling, what he will continue to do."
